A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AMENDMENT NO. 2 TO THE MEMORANDUM OF
AGREEMENT WITH SOUTHEAST MISSOURI STATE
UNIVERSITY FOR IMPROVEMENTS TO CAPAHA FIELD
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The City Manager, for and on behalf of the City
of Cape Girardeau, Missouri, is hereby authorized to execute
Amendment No. 2 to the Memorandum of Agreement with Southeast
Missouri State University, for improvements to Capaha Baseball
Field. The Amendment shall be in substantially the form attached
hereto as Exhibit A, which document is hereby approved by the
City Council, and incorporated herein by reference, with such
changes therein as shall be approved by the officers of the City
executing the same.

AMENDMENT NO. 2
TO
THE MEMORANDUM OF AGREEMENT
BETWEEN THE CITY OF CAPE GIRARDEAU, MO
AND
SOUTHEAST MISSOURI STATE UNIVERSITY
FOR THE DESIGN AND INSTALLATION OF SCULPTURE
AT THE FOUNTAIN STREET ROUNDABOUT
AND
IMPROVEMENTS TO CAPAHA FIELD
DATED APRIL 19, 2016
This Amendment applies only to Section 2 under Capaha Field Improvements. All other items
listed in the Memorandum of Agreement and executed Amendments shall remain unchanged.
Replace Section 2 under Capaha Field Improvement in its entirety with the following:
1) The City and the University will jointly fund and build an indoor hitting and storage
facility in the location of the current batting cages. The cost of the project will be split
50/50 between the parties from funds remaining in the Capaha Field Improvement
budget. The City's total contribution for the Capaha Field Improvements and the
indoor batting cage facility shall not exceed their original contribution of $920,000.
The University, in consultation with the City, will advertise the project, conduct the
bid opening, approve the contract and oversee the construction of the project. Monthly
pay applications from the contractor will be submitted to the consultant, who will
review and recommend payment, and forward to the University for approval and
payment.
2) The facility shall be property of the City and will be jointly used by the City and
University. In accordance with Section 7 of the Memorandum of Agreement, the
utilization of the facility, City maintenance responsibilities, etc. related to Capaha
Field and this indoor hitting and storage facility shall be outlined in a separate lease
agreement between the parties.
