AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT 550 NORTH SILVER SPRINGS ROAD, IN
THE CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI, FROM C-2 TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from C-2, Highway Commercial District, to R-4,
Medium Density Multifamily Residential District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, May 1, 2017, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from C-2, Highway Commercial District, to R-4, Medium
Density Multifamily Residential District .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present C-2, Highway Commercial District, to
R-4 , Medium Density Multifamily Residential District, for the
following described property:
Being a part of Outlots 79 and 82 of United States
Private Survey Number 2199, and being entirely located
in Township 31 North, Range 13 East of the Fifth
Principal Meridian, in the City and County of Cape
Girardeau, State of Missouri, described as follows :
Commencing at a 3" iron pipe on the Southwest comer of
said Outlot 79 ; thence, South 07 degrees 00 minutes 26
seconds West (previously recorded as South 07°07 ' 16"
West) a distance of 600 . 00 feet; thence, South 82
degrees 59 minutes 34 seconds East (previously
recorded as South 82°52 ' 44" East) a distance of 343
. 00 feet; thence, North 07 degrees 00 minutes 26
seconds East (previously recorded as North 07°07 ' 16"

East) a distance of 5 . 00 feet; thence, South 82
degrees 59 minutes 34 seconds East (previously
recorded as South 82°52 ' 44" East) a distance of 10 . 39
feet to the POINT OF BEGINNING; thence, continue South
82 degrees 59 minutes 34 seconds East a distance of
486 . 31 feet to a point on the west line of Pindwood
Place 2nd Subdivision; thence, along and with said
line North 25 degrees 22 minutes 11 seconds East
(previously recorded as North 25°29 ' 01" East) a
distance of39 . 89 feet; thence, leaving said line South
52 degrees 27 minutes 04 seconds East (previously
recorded as South 52°18 ' 07" East) a distance of 56 . 12
feet (previously recorded as 56 . 16 feet) ; thence,
North 25 degrees 53 minutes 20 seconds East
(previously recorded as North 26°05 ' 53" East) a
distance of 127 . 75 feet (previously recorded as 127 . 91
feet) ; thence, North 19 degrees 35 minutes 12 seconds
East (previously recorded as North 19°37 ' 53" East) a
distance of 184 . 08 feet (previously recorded as 184 . 05
feet) : thence, North 53 degrees 28 minutes 43 seconds
West (previously recorded as North 53°22 ' 19" West) a
distance of 730 . 00 feet; thence, South 36 degrees 31
minutes 17 seconds West a distance of 100 . 00 feet;
thence, South 53 degrees 28 minutes 43 seconds East a
distance of61 . 55 feet; thence, South 06 degrees 46
minutes 03 seconds West a distance of552 . 11 feet to
the POINT OF BEGINNING, containing 6 . 836 acres, more
or less .

Being a part of Outlots 79 and 82 of United States

feet to the POINT OF BEGINNING, containing 6 . 155
acres, more or less.
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of the R-4,
Medium Density Multifamily Residential District, and that such
changes authorized hereby are reasonable and in reasonable
conformity with the existing uses and value of the immediately
surrounding properties .
ARTICLE 3 . This ordinance shall be in full force and
effect ten days after its passage ar pproval .
