AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 3020
BOUTIN DRIVE, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM RMH TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1 of
this ordinance from RMH, Residential Manufactured Home District,
to C-2, Highway Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, June
4, 2012, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from RMH, Residential Manufactured Home District, to C-
2, Highway Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the
zoning of 3020 Boutin Drive, in the City and County of Cape
Girardeau, Missouri, from RMH, Residential Manufactured Home
District, to C-2, Highway Commercial District, said area including
the following described property:
THAT PART OF THE WEST HALF OF THE SOUTHWEST QUARTER OF
THE SOUTHWEST QUARTER OF SECTION 13, TOWNSHIP 31 NORTH,
RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN IN THE
COUNTY OF CAPE GIRARDEAU, IN THE STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS :
Commencing at the Southwest corner of the Southwest
Quarter of the Southwest Quarter of Section 13, Township
31 North, Range 13 East of the 5th Principal Meridian;
thence along the South line of said Section 13, North
89°34' 00" East, 26. 00 feet to a point at the
_ intersection of said line and the East Right of Way line
of Missouri State Route "W"; thence with said Right of

Way line, North 00°56' 00" West, 555 . 48 feet to the point
of beginning; thence continuing along said East line,
North 00056100" West, 342 . 54 feet; thence North
03°48' 00" West, 100 . 10 feet; thence North 00°56100"
West, 764 . 30 feet; thence leaving said East line, South
89035' 46" East, 514 . 85 feet to a point in the center of
Perryville Road; thence with the center of said Road,
South 12°17' 29" East, 466. 77 feet; thence South
07003' 00" East, 490 . 00 feet; thence South 16022' 00"
West, 200 . 50 feet to a point in the center of a creek;
thence with said creek, South 56022' 00" West, 112 . 07
feet; thence leaving said creek, South 89017' 55" West,
499 . 91 feet to the point of beginning, containing 16 . 51
acres more or less, being subject to any rights of way
or easements of record.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of a C-2, Highway
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties .
Article 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .
