HomeMy WebLinkAboutOrd.4304.03-19-2012 i l BILL NO. 12-26 ORDINANCE NO. �Q AN ORDINANCE AUTHORIZING THE ISSUANCE OF SPECIAL TAX BILLS FOR THE DEMOLITION OF DANGEROUS BUILDINGS UNDER THE PROVISIONS OF CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU WHEREAS, the Building Supervisor of the City of Cape Girardeau, Missouri, issued Orders causing certain dangerous Buildings to be demolished; and WHEREAS, the City of Cape Girardeau did cause said buildings to be demolished in accordance with the Orders thereby incurring certain expenses; and WHEREAS, the Building Supervisor authorized the issuance of certain tax bills; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS : ARTICLE 1 . There is hereby levied, and the City Clerk is hereby authorized and ordered to place on file a Special Tax Bill issued in accordance with the Order of the Building Supervisor which shall be a lien against the following described property in accordance with law, in the following amount, until paid or collected by the City of Cape Girardeau, Missouri : $5, 600 . 00- 738 Giboney Street . All that part of Lot Five (5) in Block Seven (7) in Giboney Houck' s Second Subdivision in the City and County of Cape Girardeau, Missouri, as shown by plat filed in Plat Book 1 at page 13 , described as follows : Begin at the southwest corner of said Lot No . 5 ; thence East along the south line of said Lot, 144 feet to an alley; thence North along the west line of said alley, 50 feet to the north line of said Lot No. 5 ; thence West along said north line, 52 feet; thence South 32 feet; thence West 92 feet to the west line of said Lot; thence South along said west line, 18 feet to the point of beginning. ALSO, All of Lots Six (6) , Seven (7) and Eight (8) in Block Seven (7) of Giboney Houck' s Second Subdivision in the City and County of Cape Girardeau, Missouri, as shown by plat filed in Plat Book 1 at page 13 , except a strip 6 feet wide off the east side thereof . l ARTICLE 2 . Said Tax Bill shall bear an interest rate of eight per cent (81) per annum. ARTICLE 3 . This ordinance shall be in full force and effect ten days after its passage and approval . For work done and costs and expenses incurred in abating a nuisance by demolition of a dangerous building under the provisions of Chapter 7 of the Code of Ordinances of the City of Cape Girardeau, Missouri, and chargeable against : Eunice R. Evans 3218 Northwestern Ave. , Apt . 4 Racine, WI 53404 in the City of Cape Girardeau, Missouri ; said building has been demolished in accordance with the Order of the Building Supervisor dated February 22 , 20 12 , and the costs incurred for demolition of the buildings were Five Thousand Six Hundred Dollars ($5, 600 . 00 . ) I, Gayle L. Conrad, City Clerk of the City of Cape Girardeau, Missouri, do hereby certify that the work was done as reported to the City Building Supervisor under the provisions of Chapter 7-272 (6) , said report dated February 21 , 2012 I also certify that the costs and expenses incurred by the City as set forth in said report were Five Thousand Six Hundred Dollars ($5, 600 . 00) which amount the City Council has ordered assessed as a special tax against the following described property, to-wit : 738 Giboney Street, Cape Girardeau, MO. All that part of Lot Five (5) in Block Seven (7 ) in Giboney Houck' s Second Subdivision in the City and County of Cape Girardeau, Missouri, as shown by plat filed in Plat Book 1 at page 13 , described as follows : Begin at the southwest corner of said Lot No . 5; thence East along the south line of said Lot, 144 feet to an alley; thence North along the west line of said alley, 50 feet to the north line of said Lot No . 5; thence West along said north line, 52 feet; thence South 32 feet; thence West 92 feet to the west line of said Lot; thence South along said west line, 18 feet to the point of beginning. This Special Tax Bill bears interest at the rate of eight per cent (8%) per annum from sixty (60) days after its date and is a special lien against the land herein described. The lien hereof shall continue ten (10) years after the date of issue, unless sooner paid, and in the event suit is brought to enforce such lien, then until the expiration of such litigation.
