AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY REZONING 2901 HAWTHORNE ROAD,
IN THE CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI, FROM R-1 TO AG
WHEREAS, the City Planning and Zoning Commission has voted
to recommend that all of the property described in Article 1 of
this ordinance should be rezoned from R-1, Single-family
Suburban Residential District, to AG, Agricultural District; and
WHEREAS, Public Notice of said rezoning was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, October 3 , 2011, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-1, Single-family Suburban Residential District,
to AG, Agricultural District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to rezone
the property located at 2901 Hawthorne Road, in the City and
County of Cape Girardeau, Missouri, from R-1, Single-family
Suburban Residential District, to AG, Agricultural District,
said area including the following described property:
That part of Out Lot 78B in U. S . P. Survey 2199 in the City
and County of Cape Girardeau, more particularly described
as follows : Beginning at the Northeast corner of the
Westfield Subdivision as recorded in Plat Book 9 at Page 25
of the land records of Cape Girardeau County, Missouri;
thence South 30 08155" West, along the East line thereof,
1037 . 40 feet to a f" iron rod at the Southeast corner of
Lot 82 of aforesaid subdivision; thence South 860 35' 57"
East, 35 . 68 feet to a 1/2" iron rod; thence South 340 20'
11" East, 238 . 07 feet to a 1/2" iron rod on the North line
of a tract- of land found in Deed Book 311 at Page 406 of
said land records; thence South 860 45141" East along the

North line thereof, 819 . 58 feet to a 1/2" iron rod on the
West right-of-way of Hawthorne Drive, thence Northwesterly
along a curve to the right having a radius of 1704 . 20 feet,
a length of 158 . 46 feet (chord bears North 280 27 ' 30"
West, a distance of 158 . 46 feet) ; thence departing from
said curve, North 40 52 ' 23" East, 39 . 90 feet to a 1/2 iron
rod, thence Northwesterly along a curve to the right having
a radius of 1684 . 20 feet, a length of 128 . 28 feet (chord
bears North 220 26 ' 39" West, a distance of 128 . 25 feet) ;
thence North 200 15 ' 44" West 589 . 14 feet to a curve to the
right having a radius of 935 . 97 feet; thence along said
curve a length of 413 . 88 feet (chord bears North 70 35' 39"
West, 410 . 52 feet) ; thence departing from said right-of-
way, South 890 35' 03" West 470 . 70 feet to a 1/2" iron rod,
thence North 30 18 ' 48" East, 35 . 00 feet to a 1/2 inch iron
rod; thence South 840 34152" West, 83 . 54 feet to the Place
of Beginning.
LESS AND EXCEPT 3 . 093 acres, more or less, conveyed in Book
847 at Page 698 , land records of Cape Girardeau County,
Missouri .
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an AG,
Agricultural District, and that such changes authorized hereby
are reasonable and in reasonable conformity with the existing
uses and value of the immediately surrounding properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage
