BILL NO. 11-143 ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE
PROPERTY LOCATED AT 820 NORTH SPRIGG STREET,
IN THE CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI, FROM C-1 TO R-5
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from C-1, General Commercial District, to R-5,
High Density Multifamily Residential District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Tuesday, September 6, 2011; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from C-1, General Commercial District, to R-5 , High
Density Multifamily Residential District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning of the property located at 820 North Sprigg Street
from C-1, General Commercial District, to R-5, High Density
Multifamily Residential District, said area being described as
follows :
A tract of land being the east 183 . 0 feet of Lot 77 Range
"P" of Ingram' s. Addition in the City and County of Cape
Girardeau, State of Missouri, more particularly described
as follows :
Begin at the northeast corner of said Lot 77 , said point
also being on the south right of way line of Olive Street;
thence along said south right of way line, North 81029120"
West, 133 . 57 feet to a point; thence leaving said right of
way line, South 08039102" West, 195 . 17 feet to a point;
thence North 82000100" West, 47 . 21 feet to a point; thence
South 08000102" West, 144 . 40 feet to a point on the north

right of way line of Mason Street; thence along said north
right of way line, South 81029120" East, 183 . 00 feet to the
southeast corner of said Lot 77 , said point also being on
the west right of way line of Frederick Street; thence
along said west right of way line, North 08000100" East,
340 . 00 feet to the point of beginning. Containing 1 . 21
acres more or less .
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-5,
High Density Multifamily Residential District, and that such
changes authorized hereby are reasonable and in reasonable
conformity with the existing uses and value of the immediately
surrounding properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approva
