AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 604, 608
and 620 JEFFERSON AVENUE, IN THE CITY AND
COUNTY OF CAPE GIRARDEAU, MISSOURI, FROM R-3
TO CBD
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-3, High Density Single-family
Residential District, to CBD, Central Business District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, April 4, 2011; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-3, High Density Single-family Residential
District, to CBD, Central Business District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning on property located on 604, 608 and 620 Jefferson
Avenue from R-3, High Density Single-family Residential
District, to CBD, Central Business District, said area including
the following described property:
SHADE TREE PROPERTIES, INC, OWNER IN FEE OF, ALL OF
LOT #48 OF RANGE I OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, LOCATED IN UNITED STATES PRIVATE SURVEY
NUMBER 2199, TOWNSHIP 30 NORTH, RANGE 14 EAST OF THE
5TH PRINCIPAL MERIDIAN, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI, DESCRIBED AS FOLLOWS :
Begin at the Southeast Corner of said Lot #48, thence
with the east line of said lot, and the west line of
Frederick Street, North 06°11' 20" East, 91 . 50 feet to
the North Corner of said Lot #48, thence North

83°42' 53" West, 180 . 92 feet to a point on the East
line of an existing 16. 25 foot wide Alley and the
Northwest corner of said Lot #48, thence with the West
line of said lot and the East line of said alley,
South 06°11' 17" West, 91 . 50 feet to the Southwest
corner of said Lot #48, said point being on the North
line of Jefferson Street, thence with the South line
of Said Lot, and the North Line of Jefferson Street,
South 83°42' 53" East, 180 . 92 feet to the place of
beginning and containing 0 . 380 acres, more or less,
subject any easements of record.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of a CBD,
Central Business District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
