AN ORDINANCE APPROVING THE FINAL
DEVELOPMENT PLAN, PHASE I, FOR A CASINO
COMPLEX APPROVED WITHIN THE "PD" PLANNED
DEVELOPMENT DISTRICT WITHIN THE CITY
Whereas, IOC-Cape Girardeau LLC submitted on November 17, 2010 an application for
a rezoning of certain land within the City to the "PD" Planned Development District and request
for approval of a Preliminary Development Plan for a Proposed Casino Complex, and
Whereas, on January 25, 2011, the City Council by Ordinance No. approved the
rezoning to the "PD" Planned Development District and approved the Revised Preliminary
Development Plan pursuant to Section 30-341 of the City Code, and
Whereas, on January 12, 2011, IOC-Cape Girardeau LLC submitted a Final
Development Plan to the Planning and Zoning Commission that was reviewed and recommended
for approval subject to certain conditions consistent with those provided herein,
Whereas, the City Council has reviewed the Final Development Plan and seeks to
approve it subject to submission of such final detailed site plan information to be submitted prior
to issuance of building permits,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
Article 1. The Final Development Plan, Phase 1, for a Proposed Casino Complex submitted
by IOC-Cape Girardeau LLC dated January 12, 2011, and on file with the City Clerk, and
incorporated herein by this reference, is hereby approved subject to submission and approval a
site plan showing final utility plan details and such other final details as required by the City
Manager in accordance with Section 25-1307 and all other federal, state and city ordinances
applicable to site plans or development plans, which shall be submitted at or before the time
building plans are submitted, and any such approved final development plan shall be a condition
of the authority granted by this Ordinance. Building permits shall not be issued for an authorized
use until such approved final site plan information shall have been submitted and approved by
the City as for such use. Future final development plans shall be submitted for future uses.
Article 2. Effective Date. This Ordinance shall be in full force and effect ten days after its
passage and approval.
