HomeMy WebLinkAboutOrd.4916.12-05-16 PERMANENT SANITARY SEWER EASEMENT Greek Housing Phase 2 KNOW ALL MEN BY THESE PRESENTS: SOUTHEAST MISSOURI UNIVERSITY FOUNDATION, herein referred to as "Grantor" in consideration of the mutual covenants and agreements herein set forth, agrees to grant and convey to the CITY OF CAPE GIRARDEAU, Missouri, hereinafter referred to as "Grantee", and the Grantee agrees to accept, a PERMANENT SEWER EASEMENT, in, upon, over and across that certain tract of land described by metes and bounds herein and made a part hereof. A Twenty (20) feet wide Sanitary Sewer Easement over and across a tract of land being part of Outlot 72 of the City of Cape Girardeau, in U.S. Survey 2199 in Township 31 North Range 13 East of the Fifth Principal Meridian, City of Cape Girardeau, Cape Girardeau County, Missouri and being more particularly described as follows: Commencing at the southeast corner of a tract of land as conveyed to the SEMO University Foundation, by instrument recorded in Book 441, Page 311 of the Cape Girardeau County records; thence along the south line of said SEMO University Foundation tract, North 84 degrees 18 minutes 08 seconds West, 131,98 feet to its intersection with the direct northeasterly prolongation of the east line of an existing Twenty (20) feet wide Sanitary Sewer Easement, said point also being the POINT OF BEGINNING of the herein described easement; thence departing said south line, South 04 degrees 19 minutes 02 seconds West, 3.15 feet to the northeastern corner of above said existing sanitary sewer easement; thence along the north line of said easement, North 85 degrees 40 minutes 58 seconds West, 20.00 feet to the northwestern corner of said easement; thence departing last said north line, North 04 degrees 19 minutes 02 seconds East, 3.63 feet to the south line of above said SEMO University tract; thence along said south line, South 84 degrees 18 minutes 08 seconds East, 20.01 feet to the Point of Beginning, containing 68 square feet. This easement and the right, privilege, permission and authority herein granted are perpetual and shall run with the land.
