AN ORDINANCE ACCEPTING A PERMANENT
WATERLINE EASEMENT AND A PERMANENT
SANITARY SEWER EASEMENT FROM SOUTHEAST
MISSOURI UNIVERSITY FOUNDATION, AND A
PERMANENT SANITARY SEWER EASEMENT FROM
SOUTHEAST MISSOURI STATE UNIVERSITY,
FOR PROPERTY LOCATED IN THE 1400 BLOCK
OF NORTH SPRIGG STREET, IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The City of Cape Girardeau, Missouri,
hereby accepts, and agrees to accept, a Permanent Waterline
Easement and a Permanent Sanitary Sewer Easement from
Southeast Missouri University Foundation, and a Permanent
Sanitary Sewer Easement from Southeast Missouri State
University, for property located in the 1400 Block of North
Sprigg Street, in the City of Cape Girardeau, Missouri,
described as follows :
Permanent Sanitary Sewer Easement
Southeast Missouri University Foundation
A Twenty (20) feet wide Sanitary Sewer Easement
over and across a tract of land being part of
Outlot 72 of the City of Cape Girardeau, in U. S .
Survey 2199 in Township 31 North Range 13 East of
the Fifth Principal Meridian, City of Cape
Girardeau, Cape Girardeau County, Missouri and
being more particularly described as follows :
Commencing at the southeast corner of a tract of
land 'as conveyed to the SEMO University
Foundation, by instrument recorded in Book 441,
Page 311 of the Cape Girardeau County records ;

KNOW ALL PERSONS BY THESE PRESENTS: SOUTHEAST MISSOURI UNIVERSITY
FOUNDATION, in consideration of the sum of One Dollar ($1.00) and other good and valuable
consideration, the receipt of which is hereby acknowledged, do hereby grant, bargain, sell
and convey to the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal Corporation,
hereinafter referred to as the "City", the right, privilege, permission and authority to enter on
and upon the following described property, located in the City and County of Cape Girardeau,
Missouri, to-wit:
A Twenty (20) feet wide Waterline Easement over and across a tract of land being part of Outlot 72 of
the City of Cape Girardeau, in U.S. Survey 2199 in Township 31 North Range 13 East of the Fifth

use said property to excavate, build, and construct and maintain certain improvements, in,
on, upon, or across said described property, together with all the useful, necessary and
proper adjuncts, appurtenances, and appliances in connection therewith. This easement and
the right, privilege, permission and authority herein granted are perpetual and shall run with
the land.
The undersigned covenant that they are the owners in fee simple of the above
described property and have the legal right to convey the same,
