AN ORDINANCE ACCEPTING TEMPORARY
CONSTRUCTION EASEMENTS FROM THE FAMILY
TRUST UNDER INDENTURE OF TRUST OF
CHARLES L. HUNZEf DATED JULY 271 2004,
AS AMENDED, AND SOUTHEAST MISSOURI
STONE COMPANY F/K/A SOUTHEAST MISSOURI
STONE CO., FOR '!'HE SOUTH SPRIGG STREET
BRIDGE PROJECT, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY "ITIS COUNCIL OE" THE CITY 01°' CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS
ARTICLE 1. The City of Cape Girardeau, Missouri,
hereby accepts, and agrees to accept Temporary Construction
Easements from the Family Trust Under Indenture of Trust of
Charles L. Hunze, dated July 27, 2004, as amended, and
Southeast Missouri Stone Company f/k/a Southeast Missouri
Stone Co., for the South Sprigg Street Bridge Project, in
the City of Cape G-irardeau, Missouri-, described as follows:
Charles L. Hunze, Jr., Trustee of the Family
Trust Under Indenture of Trust of Charles L.
Hunze dated July 27, 2004, as amended
A tract of land being a part of US Survey 2199,
according to the plat thereof recorded in Deed
Book 2013 Page 9426 of the Cape Girardeau County
Records, Township 30 North - Range 14 East Cape
Girardeau County, Missouri and being more
particularly described as:

Commencing at the southeast corner of a tract of
land being a part of US Survey 2199 as recorded
in Deed Book 2013 Page 9426, of the Cape
Girardeau County Records thence North 9 degrees
10 minutes 9 seconds East a distance of 82.00
feet to a point; thence along a curve to the
right having a radius of 753.65 feet, an arc
distance of 103.98 feet, having a chord length of
103.90 feet and a chord direction of North 1.3
degrees 7 minutes 18 seconds East to a point;

according to the plat thereof recorded in Plat
Book 2 Page 42 of the Cape Girardeau County
Records, Township 30 - Range 14 East, Cape
Girardeau County, Missouri and being more
particularly described as:

Beginning at the northwest corner of the land
thereof recorded in Deed Book 349 Page 755 of the
Cape Girardeau County Records, thence South 83
degrees 36 minutes 53 seconds East a distance of
123.56 feet to a point; thence South 20 degrees
28 minutes 22 seconds West a distance of 42.04
feet to a point; thence North 82 degrees 8
minutes 1 second West a distance of 122.96 feet
to a point; thence North 20 degrees 28 minutes 22
seconds East a distance of 21.78 feet to a point;
thence along a curve to the right having a radius

ARTICLE 2. Pursuant to Section 3.15(a) of the Charter
of the City of Cape Girardeau, Missouri, this measure is
adopted as an emergency measure as it constitutes a Bill
concerning the immediate preservation of public peace,
property, health, safety or morals. Specifically,
expedition of construction of the South Sprigg Street
Bridge Project would allow public use as soon as possible.
Accordingly, this ordinance will take effect immediately
upon its passage and approval.
