A RESOLUTION ACKNOWLEDGING RECEIPT OF AN ANNEXATION
PETITION FROM THE SHIRLEY M BALDWIN REVOCABLE TRUST
U/A DATED AUGUST 27, 1996, AND SETTING A PUBLIC HEARING
REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for voluntary annexation has been presented,
to the City Council of Cape Girardeau, Missouri, requesting that
certain property be annexed into the City of Cape Girardeau,;
Missouri; and
WHEREAS, the Petition has been presented in accordance with
Chapter 71 012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property,
owners, and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such areas should be
annexed into the City of Cape Girardeau
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF,
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS
ARTICLE 1 That the City Council of Cape Girardeau, Missouri,
hereby accepts and receives a Petition for voluntary annexation of
certain real estate, described as follows
All of the part of Fractional Section 9, all in Township
31 North, Range 13 East of the Fifth Principal Meridian,
in the County of Cape Girardeau, State of Missouri, and
more particularly described as follows Commence at a 2
1/2 inch dia Iron pipe marking the southwest corner of
said United States Private Survey No 790, thence with the
south line of said Survey, South 83 degrees 44' 23" East,
2615 89 feet to a point where the south line of said
U S P S 790 intersects the easterly line of the Southeast
University Foundation Property described in Deed Book 551
at page 569, thence South 03 degrees 20' 52" West, 427 00
feet, thence South 84 degrees 02' 43" East, 1686 71 feet
to the place of beginning, thence North 10 degrees 35' 56"
West, 41 67 feet to a found 1/2 inch dia iron rod; thence
North 77 degrees 23' 36" East, 390 13 feet to a found 1/2
inch iron rod, thence South 03 degrees 53' 12" East,
320 99 feet, to a point in the center of County Road #618,
thence with the center of said road, North 87 degrees 04'
39" West, 380 57 feet, thence leaving the center of said
County Road 618, North 47 degrees 04' 39" West, 76 00
feet, thence South 79 degrees 07' 21" West, 56 80 feet,
thence North 35 degrees 52' 21" East, 165 00 feet to the
place of beginning and containing 2 52 acre, more or less

25 degrees 44' 49" East, 272 89 feet, thence South 77
degrees 23' 36" West, 390 13 feet to the place of
beginning and containing 1 65 acres, more or less
ARTICLE 2 Be it further resolved that in accordance with
Chapter 71 012 RSMo it is now ordered that a public hearing be set
for October 19, 2015, at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation
ARTICLE 3 It is further resolved that notice of said public
hearing be published in a newspaper of general circulation qualified
to publish legal matters not less than seven (7) days prior to
October 19, 2015

Petitioner.
PETITION FOR ANNEXATION
1. Come now Charles R. Baldwin, Trustee of The Shirley M. Baldwin Revocable Trust U/A dated August 27,
1996, and states that he is the owner of all fee interest of record of the following described real property, being
in Cape Girardeau County, Missouri:
All of the part of Fractional Section 9, all in Township 31 North, Range 13 East of the Fifth
Principal Meridian, in the County of Cape Girardeau, State of Missouri, and more particularly
described as follows: Commence at a 2 1/2 inch dia. Iron pipe marking the southwest corner of said
United States Private Survey No. 790; thence with the south line of said Survey, South 83 degrees
44'23" East, 2615.89 feet to a point where the south line of said U.S.P.S 790 intersects the easterly
line of the Southeast University Foundation Property described in Deed Book 551 at page 569;
thence South 03 degrees 20' 52" West, 427.00 feet; thence South 84 degrees 02' 43" East, 1686.71
feet to the place of beginning;thence North 10 degrees 35' 56" West, 41.67 feet to a found 1/2 inch
dia. iron rod;thence North 77 degrees 23' 36" East, 390.13 feet to a found 1/2 inch iron rod;thence
South 03 degrees 53' 12" East, 320.99 feet, to a point in the center of County Road #618; thence
with the center of said road, North 87 degrees 04' 39" West, 380.57 feet; thence leaving the center
of said County Road 618,North 47 degrees 04' 39" West, 76.00 feet; thence South 79 degrees 07'
21" West, 56.80 feet; thence North 35 degrees 52' 21" East, 165.00 feet to the place of beginning
and containing 2.52 acre,more or less.

277.76 feet; thence South 25 degrees 44' 49" East, 272.89 feet; thence South 77 degrees 23' 36"
West, 390.13 feet to the place of beginning and containing 1.65 acres,more or less.
Subject to terms, conditions, restrictions,reservations and easements of record, if any.
2. Charles R. Baldwin does hereby petition to have the above described real property annexed to and included
within the city limits of the City of Cape Girardeau, Missouri.
3. This Petition shall be a continuing obligation running with the land, and shall bind the subsequent owners,their
heirs, executors, administrators, successors, assigns, and/or legal representatives. It is understood that this
instrument will be recorded in the Office of the Recorder of Deeds of Cape Girardeau County and shall be of
record.

WHEREFORE, Charles R. Baldwin agrees that the City Council of the City of Cape Girardeau, Missouri,
should, by ordinance, extend the city limits of the City of Cape Girardeau to include the above described real
property,taking whatever action necessary to facilitate said annexation.
