ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 890
SOUTH KINGSHIGHWAY, IN THE CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI FROM M-2 TO M-1
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from M-2, Heavy Manufacturing/Industrial
District, to M-1, Light Manufacturing/Industrial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, September 8, 2014, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from M-2, Heavy Manufacturing/ Industrial District, to
M-1, Light Manufacturing/Industrial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present M-2, Heavy Manufacturing/ Industrial
District, to M-1, Light Manufacturing/ Industrial District, for
the following described property:
A PARCEL OF LAND LOCATED IN U.S.P.S. NO. 222 IN
TOWNSHIP 30 NORTH, RANGE 13 EAST FURTHER DESCRIBED AS
FOLLOWS:
START AT THE SOUTHEAST CORNER OF FRACTIONAL SECTION
12; THENCE NORTH 84 DEG. 6' WEST 525.3 FEET FOR A
POINT OF BEGINNING; THENCE CONTINUE ONWARD NORTH 84
DEG. 06' WEST 385.0 FEET FOR A CORNER IN THE NORTHWEST
LINE OF U.S. HIGHWAY #61; THENCE NORTH 49 DEG. 14'
EAST 249.1 FEET FOR A CORNER; THENCE NORTH 77 DEG. 02'
EAST 208.0 FEET FOR A CORNER; THENCE SOUTH 1 DEG. 55'
58" WEST, 249.05 FEET TO THE POINT OF BEGINNING.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an M-1,
Light Manufacturing/ Industrial District, and that such changes
authorized hereby are reasonable and in reasonable conformity
with the existing uses and value of the immediately surrounding
properties.
Article 3. This ordinance shall be in full torce ana
effect ten days after its passage and approval.
