The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Supplemental Agreement No. 2,with Crawford, Murphy, and Tilly, Inc., for the construction phase services extension regarding the construction of T -Hangars at the Cape Girardeau Regional Airport, in the City of Cape Girardeau, Missouri. The Agreement shall be in substantially the form attached hereto as Exhibit A, which document is hereby approved by the City Council, with such changes therein as shall be approved by the officers of the City executing the same. Conrad, City Clerk Airport Name: Cape Girardeau Regional Airport Project No.: 12-077A-1 County: Scott AVIATION PROJECT CONSULTANT SUPPLEMENTAL AGREEMENT NO. 2 - CONSTRUCTION PHASE SERVICES EXTENSION THIS SUPPLEMENTAL AGREEMENT NO. 2 -CONSTRUCTION PHASE SERVICES EXTENSION is entered into by the City of Cape Girardeau (hereinafter, "Sponsor") and Crawford, Murphy & Tilly, Inc. (hereinafter, "Consultant"). WITNESSETH: WHEREAS, the Sponsor and the Consultant entered into an Agreement on September 1, 2011, to accomplish a project at the Cape Girardeau Regional Airport, (hereinafter, "Original Agreement"); and WHEREAS, the Sponsor and the Consultant entered into Supplemental Agreement No.1 on July 3, 2013, to otherwise complete, extend or continue the Original Agreement as provided herein. WHEREAS, additional drainage work was added to the project which required additional effort by the consultant. WHEREAS, the Sponsor and the Consultant now desire to enter into Supplemental Agreement No. 2 -Construction Phase Services Extension to otherwise complete, extend or continue the Original Agreement. NOW, THEREFORE, in consideration of the mutual promises, covenants, and representations contained herein the parties agree as follows: (1) SCOPE OF SERVICES: (A) The Services to be provided by the Consultant under Supplemental Agreement No. 2 -Construction Phase Services Extension are extensions of the scope of services originally provided in the Supplemental Agreement No.1- Construction Phase Services. These additional professional services are generally described and defined in Section (17) of the Original Agreement and Exhibit II — SA1. (2) FEES AND PAYMENTS: (A) The Consultant shall be reimbursed in accordance with Section (9) of the Original Agreement. (B) The costs of Supplemental Agreement No. 2 -Construction Phase Services Extension shall be in addition to the cost of the Original Agreement. (C) The lump sum fee and maximum amount payable included in Section (9) of the Original Agreement shall remain the same as follows: Design & Bidding Phase Services Construction Phase Services ORIGINAL AMOUNT SUPPLEMENTAL AGREEMENT NO. 1 TOTAL Lump Sum $27,668.62 $0.00 $27,668.62 Max. (E) Estimated costs for the services in Supplemental Agreement No. 2 are defined in Exhibit IV - SA2 and Exhibit V - SA2, which are attached hereto and incorporated herein by reference. (3) ORIGINAL AGREEMENT: Except as otherwise modified, amended, or supplemented by this Supplemental Agreement No. 2 -Construction Phase Services Extension, the Original Agreement and the Supplemental Agreement No. 1 -Construction Phase Services between the parties shall remain in full force and effect and the terms of the Original Agreement and Supplemental Agreement No.1-Construction Phase Services shall extend and apply to this Supplemental Agreement No. 2 -Construction Phase Services Extension.
