ORDINANCE NO.
AN ORDINANCE PROVIDING FOR THE EXTENSION OF
A SALES TAX IN THE AMOUNT OF ONE-EIGHTH OF
ONE PERCENT FOR THE PURPOSE OF PROVIDING
REVENUES FOR THE OPERATION OF THE CAPE
GIRARDEAU MUNICIPAL FIRE DEPARTMENT, AND
CALLING AN ELECTION IN THE CITY OF CAPE
GIRARDEAU, MISSOURI, ON THE QUESTION OF
WHETHER TO EXTEND SUCH SALES TAX
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri (the "City") currently imposes a sales tax of one-
quarter of one percent pursuant to Section 321.242 et seq. of
the Revised Statutes of Missouri, as amended, for the purpose of
providing revenues for the operation of the Cape Girardeau
Municipal Fire Department; and
WHEREAS, one-half of the City's aforementioned fire sales
tax, i.e., one-eighth of one percent, is currently set to expire
on December 31, 2014; and
WHEREAS, the City Council desires to place a proposition on
the November 4, 2014, ballot to extend the imposition of the
one-eighth of one percent portion of the sales tax which is
currently set to expire on December 31, 2014, for the purpose of
providing revenues for the operation of the Cape Girardeau
Municipal Fire Department; and
WHEREAS, the approval of the proposition will authorize the
extension of this existing portion of the fire sales tax beyond
its December 31, 2014, expiration date, but will not result in
any increase in the amount of the tax.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
Section 1. There is hereby extended the imposition of the
existing one-eighth of one percent portion of the fire sales tax
which is currently scheduled to expire on December 31, 2014,
upon all sellers within the City of Cape Girardeau, Missouri,
for the privilege of engaging in the business of selling
tangible personal property or rendering taxable services at
retail, which are subject to taxation under the provisions of
Section 144.010 to 144.525, inclusive, of the Revised Statutes
of Missouri, including of all sales of metered water services,
electricity, electrical current and natural, artificial or
propane gas, wood, coal, or home heating oil for domestic use
pursuant to Section 144.032, for the purpose of providing
revenues for the operation of the Cape Girardeau Municipal Fire
Department, which said sales tax extension shall expire on
December 31, 2035.
Section 2. The extension of the imposition of the one-
eighth of one percent sales tax referred to in Section 1 shall
become effective as provided by law upon approval thereof by a
majority of the votes cast on the proposition by the qualified
voters of the City voting thereon, and shall be in addition to
the other one-eighth of one percent fire sales tax currently in
effect in the City which is not subject to an expiration date,
and will result in a total fire sales tax of one-quarter of one
percent.
Section 3. An election is hereby ordered to be held in the
City of Cape Girardeau, Missouri, on Tuesday, November 4, 2014,
on the following proposition:
PROPOSITION
Shall the City of Cape Girardeau, Missouri,
extend the imposition of the City's existing
fire sales tax of one-eighth of one percent
(1/8 of 1%) beyond its current expiration
date for the purpose of providing revenues
for the operation of the Cape Girardeau
Municipal Fire Department? This one-eighth
of one percent (1/8 of 1%) sales tax
extension shall expire on December 31, 2035.

Section 4. The form of the Notice of Election for said
election, a copy of which is attached hereto and made a part
hereof, is hereby approved.
Section 5. The City Clerk is hereby authorized and directed
to notify the County Clerk of Cape Girardeau County, Missouri,
of the adoption of this Ordinance no later than 5:00 p.m. on
Tuesday, August 26, 2014, and to include in said notification
all of the terms and provisions required by Chapter 115 of the
Revised Statutes of Missouri, as amended.
Section 6. If any section, subsection, sentence, clause,
phrase or portion of this Ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
Section 7. This Ordinance shall be in full force and effect
ten (10) days after its passage and approval.

NOTICE OF ELECTION
CITY OF CAPE GIRARDEAU, MISSOURI
Notice is hereby given to the qualified voters of the City
of Cape Girardeau, Missouri, that the City Council of the City
has called an election to be held in the City on Tuesday,
November 4, 2014, commencing at 6:00 a.m. and closing at 7:00
p.m., on the proposition contained in the following sample
ballot:

Shall the City of Cape Girardeau, Missouri,
extend the imposition of the City's

providing revenues for the operation of the
Cape Girardeau Municipal Fire Department?
This one-eighth of one percent (1/8 of 1%)
sales tax extension shall expire on
December 31, 2035.

INSTRUCTIONS TO VOTERS: If you are in favor of the
proposition, place an X in the box opposite "YES." If
you are opposed to the proposition, place an X in the
box opposite "NO. "
The approval of the proposition will authorize the levy
and collection of a one-eighth of one percent (1/8 of 1%) sales
tax in addition to the other sales taxes provided for by law on
all retail sales made in the City that are subject to taxation.
The election will be held at the following polling places in
the City:
