AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 1668
HELMSDALE DRIVE, IN THE CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-1 to R-2
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-1, Single -Family Suburban Residential
District, to R-2, Single -Family Urban Residential District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, June 2, 2014, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-1, Single -Family Suburban Residential District,
to R-2, Single -Family Urban Residential District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present R-1, Single -Family Suburban
Residential District, to R-2, Single -Family Urban Residential
District, for the following described property:
THAT PART OF LOT P18 OF THE LOCHS AT DALHOUSIE -
CORRECTED AMENDED AND THAT PART OF U.S.P.S. 3139 BEING
IN TOWNSHIP THIRTY (30) NORTH, RANGE THIRTEEN (13)
EAST, CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI,
DESCRIBED AS FOLLOWS:
COMMENCE AT THE SOUTHERNMOST CORNER OF SAID LOT P18,
SAID CORNER BEING ON THE NORTH RIGHT OF WAY LINE OF
HELMSDALE DRIVE; THENCE NORTH 44044'30" EAST, 106.13
FEET TO THE POINT OF BEGINNING; THENCE NORTH 56000'40"
WEST, 122.04 FEET; THENCE NORTH 14049'29" EAST, 7.29
FEET; THENCE SOUTH 61042'46" EAST, 128.81 FEET; THENCE
SOUTH 44044'30" WEST, 20.04 FEET TO THE POINT OF
BEGINNING AND CONTAINING 0.038 ACRES, MORE OR LESS,
BEING SUBJECT TO ANY RIGHT OF WAYS OR EASEMENTS OF
RECORD, AS SHOWN ON THE ACCOMPANYING PLAT.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-2,
Single -Family Urban Residential District, and that such changes
authorized hereby are reasonable and in reasonable conformity
with the existing uses and value of the immediately surrounding
properties.
