AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT SILVER SPRINGS ROAD AND PIONEER
DRIVE, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI, FROM R-1 AND RMH TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this Ordinance from R-1, Single -Family Suburban Residential
District and RMH, Residential Manufactured Home District, to C-
2, Highway Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, June 2, 2014; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-1, Single -Family Suburban Residential District
and RMH, Residential Manufactured Home District, to C-2, Highway
Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning of the property located at Silver Springs Road and
Pioneer Drive, in the City and County of Cape Girardeau,
Missouri, from R-1, Single -Family Suburban Residential District
and RMH, Residential Manufactured Home District, to C-2, Highway
Commercial District, said area being the following described
property:
A PART OF SURVEY NO. 174, TOWNSHIP 30 NORTH, RANGE 13 EAST OF THE FIFTH
PRINCIPAL MERIDIAN IN CAPE GIRARDEAU COUNTY MISSOURI, DESCRIBED AS
FOLLOWS:
Begin at centerline station 46+15.50 of Relocated Rte. 74, Thence South 070 33' 25" East, 240.78
feet and from centerline station 14+00 of Relocated Silver Springs Road, Thence

Commence at an Iron Pipe at the Northeast Corner of said U.S.P. Survey #174; Thence
N 820 51' 56" W, along the North Line thereof, a distance of 648.53 feet to a point on the
Southerly Right of Way Line of Missouri State Highway #74 and the Point of Beginning; Thence
departing from said Right of Way, S 04° 32'28" W, a distance of 152.89 feet to a'/° Iron Rod;
Thence S 83° 29'570 W, a distance of 131.27 feet to a W Iron Rod; Thence S 06° 02'21" W, a

Missouri. As per Survey by Scott A. Richards, Professional Land Surveyor #2359, dated April of
2014. Subject to existing Easements of Record if any.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of a C-2,
Highway Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties.
Article 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
