AN ORDINANCE REPEALING ORDINANCE NO. 4566
PROVIDING FOR THE EXTENSION OF A SALES TAX IN THE
AMOUNT OF ONE-EIGHTH OF ONE PERCENT FOR THE
PURPOSE OF PROVIDING REVENUES FOR THE PURPOSE OF
PROVIDING REVENUES FOR THE OPERATION OF THE CAPE
GIRARDEAU MUNICIPAL FIRE DEPARTMENT, AND CALLING
AN ELECTION ON THE QUESTION TO EXTEND SUCH SALES
TAX IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
Article 1. Ordinance No. 4566, an ordinance providing for the
extension of a sales tax in the amount of one eighth of one percent
for the purpose of providing revenues for the operation of the Cape
Girardeau municipal fire department, and calling an election in the
City of Cape Girardeau, Missouri, on the question of whether to extend
such sales tax is hereby repealed.
Article 2. It is found and declared by the City Council that the
order to call for an election to be held in the City on Tuesday,
August 5, 2014, pursuant to Ordinance No. 4566, is hereby null and
void.
Article 3. It is found and declared by the City Council that an
emergency exists as provided in the City Charter Section 3.15, in that
the Council wishes to amend the Notice to the Clerk of the County
Commission of Cape Girardeau County, Missouri, and remove the
proposition from the ballot on August 5, 2014, as listed in Ordinance
No. 4566, adopted by the City Council on May 5, 2014, and to
officially notify the election authority of this change no later than
5:00 o'clock P.M. on May 27, 2014, and to include in said notification
all of the terms and provision required by the Comprehensive Election
Act, Chapter 115, Missouri Revised Statues, as amended. The City
Council further finds that the Charter specifically allows an
ordinance regarding the calling of an election or submission of a
proposal to the people as an emergency measure.
Article 4. The Mayor, the City Clerk and other officers and
representatives of the City are hereby authorized and directed to take
such other action as may be necessary to carry out the purpose and
intent of this Ordinance.
Article 5. If any clause, word, paragraph, section or other part
or portion of this Ordinance is held to be invalid, illegal or
unconstitutional for any reason, the City Council hereby declares it
would nevertheless have enacted the remaining portions thereof and
such remaining portions shall remain in full force and effect.
Article 6. This Ordinance shall be in full force and effect from
and after its passage.
