AN ORDINANCE AUTHORIZING THE ACQUISITION OF
PERMANENT DRAINAGE EASEMENTS AND TEMPORARY
CONSTRUCTION EASEMENTS, FROM VARIOUS PROPERTY
OWNERS FOR THE MELROSE DRAINAGE IMPROVEMENT
PROJECT, IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Staff is authorized and directed
to acquire certain property from various property owners
needed for Permanent Drainage Easements and Temporary
Construction Easements, for the Melrose Drainage
Improvement Project on Melrose Avenue and Westwood Drive.
The City staff is hereby authorized and directed to accept
offers of donation of property needed, make appropriate
offers of purchase to the owners of the properties based on
values provided by professional appraisers; to negotiate
with the owners of the property in an effort to reach
agreement for the purchase of the property needed and if
the negotiations fail, then to proceed to acquire the
needed properties through the exercise of the City's powers
of Eminent Domain. All of the above actions heretofore
taken by City Staff relating to this Project are hereby
authorized and ratified by the City Council.

A Permanent Drainage Easement in all of Lot 5 and
the West 15 ft of Lot 6 Block 7 of Alma Schrader
Subdivision, in the City of Cape Girardeau,
Missouri, said easement described as follows:
All the grantor's land lying in part of
Fractional Section 25, Township 31 North, Range
13 East of the Fifth Principal Meridian, City and
County of Cape Girardeau, State of Missouri,
being more particularly described as follows:
Beginning at the southwest corner of Lot 5, Block
7 of Alma Schrader Subdivision as recorded in the
land records of the County Recorder's Office in
Deed Book 663 Page 429; Thence along the west
line of said lot, N 01' 05' 53" W, 130.00 feet to
the northwest corner of said lot; Thence leaving
said west line and along the north line of said
lot, N 89° 39' 07" E, 5.0 feet; Thence leaving
said north line, S 01' 05' 53" E, 70.0 feet;
Thence eastward N 89° 39' 07" E, 10.0 feet; Thence
Thence S O1° 05' 53" F„ 60.0 feet to a point on
the south line of said lot; Thence along said
south line, S 890 39' 07" W, 1.5.0 feet to the
point of beginning.

A Permanent Drainage Easement in all of Lot 4 and
the east 25 feet of Lot 3 Block 7 of Alma
Schrader Subdivision, in the City of Cape
Girardeau, Missouri, said easement described as
follows: All the grantor's land lying in part
of Fractional Section 25, Township 31 North,
Range 13 East of the Fifth Principal Meridian,
City and County of Cape Girardeau, State of
Missouri, being more particularly described as
follows: the area 10 feet wide along and
parallel to the eastern property line of said Lot
4, Block 7 of Alma Schrader Subdivision.

North, Range 13 East of the Fifth Principal
Meridian, City and County of Cape Girardeau,
State of Missouri, being more particularly
described as follows:

Beginning at the southeast corner of Lot 9 of
Sunset View as recorded in the land records of
the County Recorder's Office in Deed Book 2009
Page 10153; Thence along the south line of said
lot, S 89° 39' 07" W, 30.00 feet; Thence leaving
said south line, N 58° 29' 27" E, 34.78 feet to a
point on the east line of said lot; Thence along
said east line, S O1° 05' 53" E, 18.00 feet to the
point of beginning, containing 270 square feet
more or less.

North, Range 13 East of the Fifth Principal
Meridian, City and County of Cape Girardeau,
State of Missouri, being more particularly
described as follows: Beginning at the
southeast corner of Lot 9 of Sunset View as
recorded in the land records of the County
Recorder's Office in Deed Book 2009 Page 10153;
Thence along the south line of said lot, S 89° 39'
0"1" W, 39.66 feet; Thence leaving said south
line, N 58° 29' 27" E, 45.99 feet to a point on
the east line of said lot; Thence along said east
line, S 01' 05' 53" E, 23.80 feet to the point of
beginning, containing 472 square feet more or
less.
Less and except 270 square feet of land taken for
permanent easement, leaving 202 square feet.

A Permanent Drainage Easement in Lot 8 Block 1 of
Westwood Subdivision, in the City of Cape
Girardeau, Missouri, said easement described as
follows: All the grantor's land lying in part
of United States Private Survey No. 2198,

Township 31 North, Range 13 East of the Fifth
Principal Meridian, City and County of Cape
Girardeau, State of Missouri, being more
particularly described as follows: Beginning
at the southwest corner of Lot 8, Block 1 of
Westwood Subdivision as recorded in the land
records of the County Recorder's Office in Deed
Book 2006 Page 843; Thence along the west line of
said lot, N 00° 20' 53" W, 16.00 feet; Thence
leaving said west line, S 45° 20' 53" E, 22.63
feet to a point on the south line of said lot;
Thence along said south line, S 89° 39' 07" W,
16.00 feet to the point of beginning, containing
128 square feet more or less.

Principal Meridian, City and County of Cape
Girardeau, State of Missouri, being more
particularly described as follows: Beginning
at the southwest corner of Lot 8, Block 1 of
Westwood Subdivision as recorded in the land
records of the County Recorder's Office in Deed
Book 2006 Page 843; Thence along the west line of
said lot, N 00° 20' 53" W, 23.07 feet; Thence
leaving said west line, S 45° 20' 53" E, 32.63
feet to a point on the south line of said lot;
Thence along said south line, S 89° 39' 07" W,
23.07 feet to the point of beginning, containing
266 square feet more or less.
Less and except 128 square feet of land taken for
permanent easement, leaving 138 square feet.
ARTICLE 2. The Council of the City of Cape Girardeau,
Missouri hereby finds and declares that the acquisition of
the above-described properties is for a public use and that
such acquisition is within the scope of the authority or
power of the City of Cape Girardeau, Missouri, and that the

acquisition of the properties is reasonable and necessary
for public use in order to provide for the construction of
the Melrose Drainage Project, on Melrose Avenue and
Westwood Drive, in the City of Cape Girardeau, Missouri.
ARTICLE 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
