AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY REZONING PROPERTY LOCATED AT
121 SOUTH MAIN STREET, IN THE CITY AND
COUNTY OF CAPE GIRARDEAU, MISSOURI, FROM R-4
TO CBD
WHEREAS, the City Planning and Zoning Commission has voted
to recommend that all of the property described in Article 1 of
this ordinance should be rezoned from R-4, Medium Density Multi
Family Residential District, to CBD, Central Business District;
and
WHEREAS, Public Notice of said rezoning was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau Missouri, and public hearing was held on
Monday, February 3, 2014, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-4, Medium Density Multi Family Residential
District, to CBD, Central Business District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to rezone
the property located at 121 South Main Street, in the City and
County of Cape Girardeau, Missouri, from R-4, Medium Density
Multi Family Residential District, to CBD, Central Business
District, said area including the following described property:
The South Fifty -Two (52) feet of Lot 1 Range "A", in
the City of Cape Girardeau, Missouri, fronting Fifty -
Two (52) feet on Main Street by a depth of Eighty -Four
(84) feet.
ALSO, the North part of the West part of Lot 2 Range
"A" in the City of Cape Girardeau, Missouri, being
more particularly described as follows: Begin at the
northwest corner of said Lot 2, Range "A"; thence in
an easterly direction, with the north line of said Lot
2, 84 feet to the west line of Main Street; thence in
a southerly direction, with said west line of Main
Street, 120.19 feet to a point 80.12 feet in a
northerly direction from the south line of said Lot
2; thence in a westerly direction, parallel to the
south line of said Lot 2, 84 feet to the west line of
said Lot 2; thence in a northerly direction, with said
west line, 120.19 feet to the beginning corner.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of a CBD,
Central Business District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties.
Article 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
