ORDINANCE NO. -e4—
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY REZONING PROPERTY LOCATED AT 18
SOUTH HANOVER STREET, IN THE CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI, FROM R-4 TO C-1
WHEREAS, the City Planning and Zoning Commission has voted
to recommend that all of the property described in Article 1 of
this ordinance should be rezoned from R-4, Medium Density Multi
Family Residential District, to C-1, General Commercial
District; and
WHEREAS, Public Notice of said rezoning was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau Missouri, and public hearing was held on
Monday, February 3, 2014, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-4, Medium Density Multi Family Residential
District, to C-1, General Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to rezone
the property located at 18 South Hanover Street, in the City and
County of Cape Girardeau, Missouri, from R-4, Medium Density
Multi Family Residential District, to C-1, General Commercial
District, said area including the following described property:
ALL OF LOTS 7 AND 10, BLOCK 2, OF WEST END PLACE
ADDITION, A SUBDIVISION ON FILE IN THE LAND RECORDS OF
CAPE GIRARDEAU COUNTY IN PLAT BOOK 2 AT PAGE 8, CITY
AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
DESCRIBED AS FOLLOWS:
Begin at the Southwest corner of said Lot 10, Block 2,
of West End Place Addition, said corner being on the
East Right of Way line of Hanover Street; thence with
the West line of said Lot 10, and the East Right of
Way line of Hanover Street, North 06°09'14" East,
106.80 feet to the Northwest corner of said Lot 7,
Block 2, of West End Place Addition; thence leaving
said Right of Way line, and with the North line of
said Lot 7 South 83°50146" East, 135.00 feet to the
Northeast corner of said Lot 7, said comer being on
the West line of a 15' Alley in Block 2 as shown on
the Plat of said West End Place Addition; thence with
the East line of said Lot 7, and the West line of said
15' Alley, South 06009'14" West, 106.80 feet to the
Southeast comer of said Lot 10, Block 2, of West End
Place Addition; thence with the South line of said Lot
10 North 83°50'46" West 135.00 feet, to the point of
beginning and containing 0.331 acre (14,418 square
feet), more or less, subject to easements of record.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of a C-1,
General Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties.
Article 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
