AN ORDINANCE VACATING AN ALLEY RUNNING SOUTH
OF MORGAN OAK TO JEFFERSON AVENUE RIGHT-OF-
WAY AND LYING BETWEEN FREDERICK STREET AND
MIDDLE STREET RIGHTS-OF-WAY, IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request from the
owners of property abutting an alley located within Range I,
running south of Morgan Oak to Jefferson Avenue right-of-way and
lying between Frederick Street and Middle Street rights-of-way,
in the City of Cape Girardeau, Missouri, to vacate said alley;
and
WHEREAS, a public hearing was held on January 21, 2014, at
7:00 p.m., at which time all interested parties were afforded
the opportunity to speak in favor of or in opposition to the
proposed vacation of the alley; and
WHEREAS, at least ten days notice of the time and place of
this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, the City Council has determined that the alley
right-of-way in question is not necessary or needed for any of
the purposes for which it was dedicated and established; and
WHEREAS, it is in the public interest that the alley
right-of-way be vacated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council hereby finds that it is in
the public interest that this alley right-of-way be vacated.
ARTICLE 2. The City's alley right-of-way on the following
described real estate:
An existing 16.25 foot wide Alleyway to be vacated in
Range "I" in the City and County of Cape Girardeau,
Missouri, more particularly described as follows:
Begin at the Northwest corner of Lot No. 43, Range
"I", also known as the Point of Beginning, thence,

Southerly, 366.0 feet to the southwest corner of Lot
40, Range "I" and the north line of Jefferson Street,
thence, West, 16.25 feet to the southeast corner of
Lot No. 47, Range "I", thence, Northerly, 366.0 feet
to the northeast corner of Lot 44 and the south line
of Morgan Oak Street, Range "I", thence, East, 16.25
feet to the Point of Beginning.
is hereby vacated.
ARTICLE 3. This ordinance shall be in full force .and effect
ten days after its passage and approval.
