A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH BRINDLEE MOUNTAIN
FIRE APPARATUS, LLC, FOR THE PLATFORM FIRE
TRUCK PURCHASE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the
City of Cape Girardeau, Missouri, is hereby authorized to
execute an Agreement with Brindlee Mountain Fire Apparatus, LLC,
for the purchase of a 2005 Smeal/Spartan 100' aerial platform
fire truck. The Agreement shall be in substantially the form
attached hereto as Exhibit A, which document is hereby approved
_ky the City Council, with such changes therein as shall be
approved by the officers of the City executing the same.
PASSED AND ADOPTED THIS DAY OF 2014.

Tenns and Conditions of Sale:
The Seller sha11 complete all items noted on Addendum A.
Apparatus will have a five(5)year�varranty beginning with date of shipment from Seller's facility in Union Grove,
AL. Warranty will cover any single component repair due to catastrophic failure in which the cost exceeds
$3,040.00(Three Thousand Dollars and no cents)un[ess repairs are due to operator error,equipment misuse,or
substandard mait�tenance. Apparatus must be maintained to manufacturer's recommended standards or warranty is
voided. Total warranty costs paid by Seller to Buyer in the fve(5)year warranty period s6a11 not exceed �
$15,000.00(Fifteen Thousand dollars and no cents). Apparatus components are engine,transmission,pump,aerial
device,electrical system,generator,axles,and body structure.
The Selier has verified that al!Spartan Warranties are transferrable to the Buyer,includ'ing the Lifetime Structural
Frame Warranty.
Buyer�vill make payment in full to SelIer prior to delivery. Seller shall be..responsible for delivery to Cape
Girardeau Fire Department in Cape Girardeau,MO, Seller�vill provide title free of Iien to Biryer follo�ving receipt
of payment.
The agreement above is subject to the prior sale of the vehicle,and good for esecutio ugh Friday, February 21,

Addendum A
The Seller shall have a 3i4 party aerial certification test completed.
The Seller shall repair any defects noted in aerial certification test noted above.
The Seller shall conduct an annual pump service test.
The Seller shall have the apparatus repainted to department specifications.
The Seller shall have the apparatus lettered and striped to department specifications.
The Seller shall complete a full service of fluids and filters, using synthetic motor oil (Royal
Purple) and synthetic transmission fluid.
The Seller shall diagnose and repair any hydraulic leaks.
The Seller shall diagnose and repair any engine oil leaks.
The Seller shall diagnose and repair any power steering leaks.
The Seller shall diagnose and repair any transmission leaks.
The Seller shall replace the left I` rear axle seal that is leaking.
The Seller shall replace all brakes.
The Seller shall replace all fires using.Goodyear tires.
The Seller shall verify that the air conditioning system is in proper working order.
The Seller shall repair a small crack in the Officer's door panel.
The Seller shall repair or replace the dghtrear fold up seat that is broken.
The Seller shall reupholster any tom seating.
The Seller shall repair, as needed, the cab lift.
The Seller shall complete spot rust treatment on undercarriage, Seller has verified with Spartan
that treatment process has no effect on manufacturer's structural frame lifetime warranty.
The Seller shall replace lighting with a LED package, per department specifications.
The Seller shall add ladder storage to the ladder for a 14' roof ladder. Storage should be located
on Driver's side behind the ladder sign.
The Seller shall modify ladder storage, IF POSSIBLE, to allow for the following compliment of
ladders: 35', 35', 20', 20', 16' and 14' ladders. Any additional remaining space shall be used for
more ladder storage than the compliment noted before and for pike pole storage..
The Seller shall remove both hose bed storages on front bumper.
The Seller shall remove the jumpline and front suction from the front bumper. Those should be
capped at the pump, or wherever appropriate and feasible.
The'Seller shall add a new diamond plate cover to the front bumper.
The Seller shall replace the C.E. Niehoff alternator on the
ep apparatus with a comparable Leece i
Neville alternator, IF POSSIBLE.
The Seller shall add a new Akron Black Max 'piston intake with a 5" Storz fitting.
The Seller shall have all breathing air bottles hydrostatic tested..
The Seller shall provide manuals from Smeal, Spartan, Hale, and Harrison Generators,
The Seller shall have a Firecom intercom system installed, if not currently on apparatus, per
department specifications.
The Seller shall add a load manager, if one does not exist on the apparatus OR the Seller shall set
a control sequence to require each set of emergency lighting to come on one at a time, IF
POSSIBLE.
The Seller shall tint the following windows on the cab: 2 rear door windows, 2 middle section
windows.
