HomeMy WebLinkAboutOrd.4533.02-03-2014BILL NO. 14-03 ORDINANCE NO. /`""3 AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY CODE, BY REZONING PROPERTY LOCATED AT 515 AND 521 NORTH BROADVIEW STREET, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI FROM C-2 TO RUMD WHEREAS, the City Planning and Zoning Commission has voted to recommend that all of the property described in Article 1 of this ordinance should be rezoned from C-2, Highway Commercial District, to RUMD, Residential Urban Mixed Density District; and WHEREAS, Public Notice of said rezoning was given as prescribed in Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, and public hearing was held on Monday, January 6, 2014, and WHEREAS, the City Council of the City of Cape Girardeau, Missouri, has elected to rezone the property described in Article 1 from C-2, Highway Commercial District, to RUMD, Residential Urban Mixed Density District; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended to rezone the property located at 515 and 521 North Broadview Street, in the City and County of Cape Girardeau, Missouri, C-2, Highway Commercial District, to RUMD, Residential Urban Mixed Density District, said area including the following described property: A part of Lot Four (4) of the Southwest Quarter of Out Lot Eighty (80), U.S.P. Survey 2199 in the County of Cape Girardeau, Missouri, described as follows: Begin at a point on the east line of the Southwest Quarter of Out Lot 80, South 8 degrees 15' West, 665.2 feet from the northeast corner of said Southwest Quarter of Out Lot 80; thence North 82 degrees 10' West, 15.0 feet to the northeast corner of the Bingenheimer lot on the south line of what is known as Clark Avenue; thence South 8 degrees 15' West parallel to the east line of said Southwest Quarter of Out Lot 80, 133.0 feet to the southeast corner of the Ben Northdurft lot for a beginning corner of the tract herein conveyed; 1 thence North 82 degrees 10' West, parallel to Clark Avenue and with the south line of said Ben Northdurft tract, 540.80 feet to a corner on the west line of said Lot 4; thence South 7 degrees 50' West, with the west line of said Lot 4, 55.0 feet to the northwest corner of the Henry Ulrich lot; thence South 82 degrees 10' East, with the north line of said Henry Ulrich lot, 540.0 feet to a point 15.0 feet West of the east line of said Southwest Quarter of Out Lot 80; thence North 8 degrees 15.0 feet West of the east line of said Southwest Quarter of Out Lot 80; thence North 8 degrees 15' East, 55.0 feet to the beginning corner. Known as: Lot Two (2) of Katie's First Subdivision in the City and County of Cape Girardeau, Missouri, as shown by plat filed in Plat Book 18 at page 5. LESS AND EXCEPT That part of Lot One (1) of Katie's First Subdivision in the City and County of Cape Girardeau, Missouri, as shown by plat filed in Plat Book 18 at page 5. ALSO: A part of Lot 4 of a subdivision of the Southwest Quarter of Out Lot No. 80, U.S.P. Survey No. 2199, City and County of Cape Girardeau, Missouri, described as follows: Start at the south corners of Lots 3 and 4 of said Southwest Quarter of Out Lot No. 80; thence N. 7` 50' E., along the line between Lots 3 and 4, 507.3 feet; thence S. 82° 10' E. 358.6 feet for the point of beginning; thence continue S. 82° 10' E., 178.82 feet to a point on the west line of Broadview Street; thence N. 7' 50' E. along the west line of Broadview Street 70.0 feet for a corner; thence N. 82' 10' W. 178.82 feet for a corner; thence S. V 50' W. 70.0 feet to the point of beginning. ARTICLE 2. The City Council hereby finds and declares that the property described in Article 1 hereof is at the present time particularly suitable for the purposes and uses of the RUMD, Residential Urban Mixed Density District, and that such 2 changes authorized hereby are reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties.
