A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION FROM DANIEL P. AND SALLY C.
FINCH, AND SETTING A PUBLIC HEARING REGARDING
THE PROPOSED ANNEXATION
WHEREAS, a Petition for annexation has been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
property be annexed into the City of Cape Girardeau, Missouri; and
WHEREAS, the Petition has been presented in accordance with
Chapter 71.012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such areas should be
annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. That the City Council of Cape Girardeau, Missouri,
does hereby accepts and receives a Petition for Voluntary Annexation
of certain real estate, described as follows:
DANIEL P. AND SALLY C. FINCH
259 Cougar Run
That part of U.S.P. Survey No. 787 in Township 30 North,
Range 13 East, County of Cape Girardeau, State of
Missouri, described as follows:
Commence at the Northeast comer of U.S.P. Survey No. 679,
being on the South line of U.S.P. Survey No. 175, and a
corner of the West line of U.S.P. Survey No. 174, in said
Township 30 North, Range 13 East, marked by a 1/2" iron
rod; thence with the following courses and distances;
North 840 00' West, 1198.70 feet; thence North 60 00'
East, 384.81 feet; thence North 83° 22' ingest, 801.30 feet,
to a point in the center of Old Bloomfield and Cape
Girardeau Road; thence with the center of said road, South
41° 55' West, 28.60 feet; thence South 31° 07' West,
204.10 feet; thence South 370 13' West, 158.20 feet;
thence South 75° 37' West, 134.32 feet; thence leaving
said road, South 47° 20' West, 1566.75 feet, to a point in
the present Cape Girardeau and Bloomfield Road; thence
with said road South 32° 02' West, 452.47 feet; thence
South 290 33' West, 289.19 feet; thence North 54° 38'
West, 25.0 feet, to a point on the Northerly line of said
road, the place of beginning; thence North 840 17' West
539.59 feet; thence South 32° 28' 00" West, 335.18 feet;
thence North 57° 32' 00" West, 399.17 feet; thence North
290 35' 50" East, 163.65 feet; thence South 840 17 East,
997.74 feet, to a point on the Northerly line of said Cape
Girardeau and Bloomfield Road; thence with said line South
35° 22' 00" West 34.52 feet, to the place of beginning.
LESS AND EXCEPT that part conveyed to the City of Cape
Girardeau in General Warranty Deed recorded January 14,
2011 in Document No. 2011-00740, land records of Cape
Girardeau County, Missouri.
ARTICLE 2. Be it further resolved that in accordance with
Chapter 71.012 RSMo it is now ordered that a public hearing be set
for January 6, 2014, at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation.
ARTICLE 3. It is further resolved that notice of said public
hearing be published in a newspaper of general circulation qualified
to publish legal matters not less than seven (7) days prior to
January 6, 2014.
