FOR THE EXPANSION OF CAPE SPLASH FAMILY WATERPARK, IN THE CITY OF CAPE GIRARDEAU, MISSOURI BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute an Agreement with Markey and Associates, Inc. for the expansion of Cape Splash Family Waterpark, in the City of Cape Girardeau, Missouri. (Engineer) and City of Cape Girardeau (Client) for the preparation of An Expansion Plan for the Cape Splash Family W aterpark Part I - General: Whereas the Client intends to evaluate the need for, and character of physical elements that will expand and/or enhance the ability of the Cape Splash Family Waterpark to attract and serve the customers thereof, the Engineer (a recognized specialist in the feasibility, planning, and design of private and public sector waterparks) agrees to provide the planning services described below. Part 2 - Work Elements 2.1. Prepare simple Base Drawings from the original park design Drawings for the Masterplan work. 2.2. Prepare a "Site Constraints" plan with the help of the Project Civil Engineer. This will include known rock outcroppings, utilities, flood plain, setbacks, steep slopes, and areas of known springs. 2.3. Meet with the staff to review the latest attendance, pricing, and demographics data as well as generate the wish list of possible expansion/upgrade components. Rank the possible expansion elements by their costs (both first costs and operational costs) and benefits, comparing new market appeal, capacity, customer satisfaction and aesthetic concerns. This entire task will be done in one trip and follow-up research and documentation in office. 2.4. Submit the draft rankings to the staff, discuss by phone, and finalize the rankings, develop a phasing schedule, and expand on operation and maintenance considerations (including schedules for planned renewal & replacements). Prepare a draft plan of the of the first and second phases of expansion/upgrade, and submit same for approval. 2.5. Upon approval of the draft masterplan, prepare a color, plan -view masterplan graphic showing the immediate and near-term proposed expansions/upgrades. Include the financial analysis (projected changes in attendance, revenues, and expenses), detailed estimates for the first phase improvements, and staffs recommendations for appropriate adjustments to the park pricing based on the improvements. 2.6. Present the plan and recommendations to the City. Page I of 2 Part 3 - Professional Fee: The Client shall pay Engineer the sum of $8,500 for the work as a lump sum, including the 2 trips and all out-of-pocket expenses. Perspective renderings or other marketing/presentation aids can be quoted and provided as an additional service and fee upon request. The fee will be invoiced by the Engineer in two increments. At the completion of Part 2.4. as described above, the Engineer shall invoice the Client for $5,000. The balance of the Lump Sum Fee shall be invoiced at the completion of the planning work. The Client shall pay the Engineer within 30 days of receipt of each invoice. Part 4 - Time of Completion: The Engineer will commence the work upon receiving a signed agreement and a written notice to proceed from the Client, and the work shall be completed within 60 -days thereafter.
