AN ORDINANCE AMENDING CHAPTER 25 OF THE CITY
CODE RELATING TO DEVELOPMENT CODE, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 25-911 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, reading as follows:
Sec. 25-911. Sidewalks and trails.
At the time street improvements are installed or
development of property occurs, sidewalks shall
be constructed as required in street standards,
Table A. There shall be a minimum of two and one-
half (2.5) feet between the curb of the street
and the sidewalk. Sidewalks shall be constructed
in accordance with the city's standards and
specifications. Sidewalks must be in acceptable
condition at the time occupancy permits are
issued. The requirement for sidewalks may be
waived under the following circumstances, as
approved by the city manager:
(a) Better pedestrian and bicycle access and
connectivity is provided by an off-street
trail that connects to sidewalks or other
trails;
(b) If there are no other sidewalks within
five hundred (500) feet of the property;
(c) If the topography of the site is such
that sidewalks are not feasible.
Multimodal trails shall be at least eight
(8) feet in width and designed, posted and
marked in accordance with the city's

standards and specifications. A public
access easement of appropriate width shall
be granted for all public trails.

follows:

driveway shall be in accordance with the city's

ARTICLE 3. Section 25-1104 (h) (2) a of the Code of
Ordinances of the City of Cape Girardeau, Missouri, reading as
follows:
Sec. 25-1104. - In general; water and sanitary sewer mains.
(h) (2) a. To construct the entire extension from the
end of the existing main to and across the entire
frontage, rear, side, or other dimension of the lot or
tract to be served as determined by the city manager
or his designee. Such extension shall be of pipe size,
as determined by the city manager or his designee,
which will provide adequate service to the area, but
in no case shall the pipe size be less than eight (8)
inches for sewer main extensions and six (6) inches
for water main extensions.

ARTICLE 4. A new Section 25-1104 (h)(7) is hereby enacted in
words and figures, to read as follows:

(h)(7) Private water wells in the city limits shall be
Prohibited, unless otherwise approved by the City
Manager. Existing private water wells will be
allowed to remain until such time a change in use
occurs unless otherwise approved by the City
Manager.
ARTICLE 5. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 6. It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
City of Cape Girardeau, Missouri, and the sections of this Code
may be renumbered to accomplish such intention.
