AN ORDINANCE AMENDING SECTION 15-12 OF THE CITY CODE, RELATING TO UNLICENSED BUSINESSES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. All of Section 15-12 of the Code of Ordinances of the City of Cape Girardeau, Missouri, which reads as follows: Sec. 15-12. - Unlawful to operate, assist, etc., an unlicensed business. No person shall engage in, operate, carry on, conduct or participate in doing any business in this city for which a license is required by this chapter or assist directly or indirectly in doing such business or any part of the same, in any manner, either as owner or proprietor or as an officer of any corporation, or as manager, agent, superintendent, servant or employee, unless a license for carrying on such business shall have been issued and shall be in force. ss.,.,.erebypealedik,Cs entety, and a new Section 15-12 is hereby enacted in lieu there, in words and figures, to read as follows: Sec. 15-12. - Unlawful to operate, assist, etc., an unlicensed business; rebuttable presumption. (a) No person shall engage in, operate, carry on, conduct or participate in doing any business in this city for which a license is required by this chapter or assist directly or indirectly in doing such business or any part of the same, in any manner, either as owner or proprietor or as an officer of any corporation, or as manager, agent, superintendent, servant or employee, unless a license for carrying on such business shall have been issued and shall be in force. (b) There shall be a rebuttable presumption that the licensee and such business is operating as an unlicensed business in violation of this Chapter, if the licensee fails to properly renew any license issued under the terms of this Chapter, or to notify the City Clerk in writing of the closure of the business and the timely filing of all statements and payments required by Section 15-88, et seq., of the City Code. ARTICLE 2. It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau, Missouri, and the sections of this Code may be renumbered to accomplish such intention. ARTICLE 3. This ordinance shall take effect and be in force from and after ten days after its final passage and approval. PASSED AND APPROVED THIS ATTEST: GayleoJ.
